Terms of Service

1. Acceptance of Terms & Eligibility

By downloading, accessing, or using the Spot application and related services ("Spot", "the App", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all of these Terms, you are expressly prohibited from using the App and must discontinue use immediately.

You must be at least 13 years of age (or the minimum legal age required to provide digital consent in your jurisdiction) to create an account and use Spot. Spot reserves the right to modify these Terms at any time. Continued use of the App following any updates constitutes your binding acceptance of the revised Terms.

2. User Accounts & Security

To post, comment, or interact with content on Spot, you must register a valid, permanent email address and complete account verification. Use of temporary, disposable, or automated email addresses is strictly prohibited. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at spot.support.official@gmail.com of any unauthorized access or security breach.

3. User-Generated Content (UGC) & Licensing

Spot enables users to upload and share photos, text, reviews, comments, and geographic coordinates ("Content").

• Ownership: You retain full ownership rights to the original Content you create and upload.
• License Grant: By submitting Content to Spot, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting or technical compression), distribute, publicly display, translate, and perform your Content in connection with operating, securing, and promoting the App. This license terminates when you delete your Content or account from the App, except to the extent retained in temporary encrypted server backups.
• Representations: You represent and warrant that you own or hold the necessary rights to the Content you upload, and that your Content does not violate the privacy rights, copyright, contract rights, or local laws of any person or jurisdiction.

4. Zero-Tolerance Policy & Prohibited Conduct

Spot maintains a strict zero-tolerance policy regarding objectionable, abusive, or unlawful content. By using Spot, you strictly agree NOT to:

• Post defamatory, harassing, hateful, sexually explicit, violent, or illegal material, or content that violates public order or morality in the Kingdom of Saudi Arabia or your local jurisdiction.
• Publish undisclosed sponsored content, commercial spam, paid advertisements, or deceptive promotional material.
• Upload photos with falsified or manipulated location metadata (EXIF), or intentionally drop pins on hazardous, restricted, military, or private residential properties without authorization.
• Use bots, scrapers, automated scripts, or fake accounts to manipulate ratings, feeds, or user interactions.
• Attempt to probe, scan, reverse-engineer, data-mine, or bypass the security controls, API endpoints, or database architecture of the App.

5. Content Moderation, Reporting & Termination Rights

To maintain platform integrity, Spot utilizes both user-driven reporting and automated safety mechanisms:

• Reporting & Quarantine: Users may report objectionable posts or comments directly within the App. Content that reaches our reporting threshold is automatically quarantined from public feeds pending review, and reported content is reviewed and acted upon within 24 hours.
• User Blocking: Users may block abusive users at any time from within the App, which immediately hides that user's Content from their feed.
• Absolute Termination Right: Spot reserves the absolute right to remove, edit, or permanently quarantine any Content, and to suspend or terminate your account at our sole discretion, at any time, with or without prior notice, and without any liability to you.

6. Assumption of Physical Risk & Location Waiver

Spot is a crowdsourced informational platform. We do not own, manage, inspect, or independently verify the safety, accessibility, legality, road conditions, weather hazards, or operational status of any physical locations shared by users.

• Assumption of Risk: By using Spot to discover or navigate to physical locations—including remote desert, mountain, coastal, or urban areas—you expressly acknowledge that travel involves inherent risks of property damage, serious bodily injury, or death. You are solely responsible for your personal safety, vehicle preparedness, terrain assessment, and compliance with all local laws and private property boundaries.
• Release of Liability: To the maximum extent permitted by law, Spot and its developers, owners, and affiliates shall NOT be held liable for any direct, indirect, incidental, special, or consequential damages resulting from physical injury, death, vehicle recovery costs, property damage, trespassing fines, or financial loss incurred while traveling to or visiting any location discovered through the App.

7. Disclaimer of Warranties & Indemnification

THE APP AND ALL CONTENT ARE PROVIDED strictly ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. SPOT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF LOCATION COORDINATES, AND NON-INFRINGEMENT.

You agree to defend, indemnify, and hold harmless Spot, its founder, developers, and infrastructure providers from and against any and all claims, liabilities, damages, losses, and legal expenses (including reasonable attorney's fees) arising out of or connected to: (a) your access to or use of the App; (b) the Content you upload; (c) your violation of these Terms; or (d) your violation of any third-party rights or applicable laws.

8. Severability & Entire Agreement

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is impossible, without affecting the validity and enforceability of the remaining provisions.

9. Governing Law & Dispute Resolution

These Terms and any dispute arising out of your use of Spot shall be governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia. Before initiating any formal legal proceeding, you agree to first contact us at spot.support.official@gmail.com and allow thirty (30) days to attempt an amicable resolution. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts in the Kingdom of Saudi Arabia. You agree to bring any claims strictly in your individual capacity and waive any right to participate in any class, collective, or representative action.
